Welcome to Rapid Identity Shift. These Terms of Service ("Terms") govern your access to and use of the website, services, coaching programs, digital products, and any other offerings provided by Kevin Gonzales ("we," "us," "our," or "Company"). By accessing our website at rapididentityshift.com or purchasing any of our services, you agree to be bound by these Terms.
PLEASE READ THESE TERMS CAREFULLY. BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR SERVICES.
1. SERVICES OVERVIEW
Kevin Gonzales provides coaching, educational content, and personal development services focused on identity transformation, manifestation practices, subconscious reprogramming, and related topics. Our services may include but are not limited to: one-on-one coaching programs, group coaching programs, online courses and digital products, guided meditations and activations, webinars and live events, email content and newsletters, and free content on YouTube and other platforms.
Kevin Gonzales is a licensed clinical hypnotherapist certified in Australia. However, our coaching services are educational and transformational in nature and do not constitute therapy, medical treatment, or professional mental health services.
2. ELIGIBILITY
You must be at least 18 years of age to use our services. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are accessing our services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
3. ACCOUNT REGISTRATION
Some of our services may require you to create an account or provide personal information. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. PAYMENT TERMS
Pricing and Payment: All prices for our services are listed in the applicable currency at the time of purchase. Payment is due at the time of purchase unless a payment plan has been expressly agreed upon in writing. We reserve the right to change our prices at any time without notice, though price changes will not affect purchases already completed.
Payment Plans: If you enroll in a payment plan, you agree to make all payments according to the agreed schedule. Failure to make timely payments may result in suspension of access to services, collection efforts, and/or additional fees. You remain obligated to pay the full program fee regardless of whether you complete the program or continue participating.
Taxes: You are responsible for any applicable taxes associated with your purchase.
5. REFUND POLICY
Due to the nature of our services and the immediate access to proprietary information, methods, and personalized coaching, all sales are final. We do not offer refunds once services have commenced or digital products have been delivered.
If you believe there are exceptional circumstances warranting consideration, you may contact us at kevin@rapididentityshift.com within 7 days of purchase. Any refund requests will be reviewed on a case-by-case basis at our sole discretion.
For payment plan clients: You are obligated to complete all payments regardless of whether you choose to continue participating in the program. Non-participation does not entitle you to a refund or cancellation of remaining payments.
6. CLIENT RESPONSIBILITIES
As a client, you agree to: participate actively and honestly in the coaching process, complete any assigned exercises, meditations, or homework, attend scheduled sessions on time or provide reasonable advance notice for rescheduling, communicate openly about your goals, challenges, and progress, take full responsibility for your own decisions and actions, and treat Kevin Gonzales and any team members with respect and professionalism.
You understand that coaching is a collaborative process and that your results depend significantly on your own effort, commitment, and implementation of the strategies discussed.
7. SCHEDULING AND CANCELLATIONS
Coaching sessions must be scheduled in accordance with the scheduling procedures provided. If you need to reschedule a session, please provide at least 24 hours advance notice. Sessions cancelled with less than 24 hours notice or no-shows may be forfeited and will not be rescheduled. We reserve the right to reschedule sessions due to unforeseen circumstances and will provide reasonable notice when possible.
8. INTELLECTUAL PROPERTY
All content provided through our services, including but not limited to coaching materials, meditations, activations, worksheets, videos, audio recordings, written content, methodologies, frameworks (including Identity Frequency Mapping), and any other proprietary information, is owned by Kevin Gonzales and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the materials for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, or exploit any of our content without express written permission.
You may not share, copy, or distribute any program materials, recordings, or login credentials with any third party. Violation of these intellectual property provisions may result in immediate termination of services without refund and may subject you to legal action.
9. CONFIDENTIALITY
We respect your privacy and will keep the contents of our coaching sessions confidential, except as required by law or with your express permission. However, we may use anonymized information for case studies, testimonials, or marketing purposes unless you specifically opt out in writing.
You agree to keep confidential any proprietary methods, strategies, or information shared during our coaching sessions and not to share them with third parties.
10. TESTIMONIALS AND PUBLICITY
By participating in our programs, you grant us permission to use your name, likeness, testimonials, and success stories for marketing and promotional purposes unless you notify us in writing that you do not wish to be featured. Any testimonials you provide are given voluntarily and may be edited for clarity or length while preserving the overall meaning.
11. DISCLAIMERS
No Guarantees: We make no guarantees regarding specific results, outcomes, or earnings. Your results will vary based on many factors including your background, dedication, desire, motivation, and actions. See our separate Earnings Disclaimer for more information.
Not Professional Advice: Our services are educational and coaching in nature. They do not constitute medical, psychological, legal, financial, or other professional advice. You should consult appropriate licensed professionals for such matters.
Health Disclaimer: Our services involve meditation, visualization, and mindset practices. If you have any medical or mental health conditions, please consult with your healthcare provider before participating. Our services are not a substitute for professional medical or mental health treatment.
"As Is" Basis: Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEVIN GONZALES, HIS TEAM, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) OUR SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) ANY CONTENT OBTAINED FROM OUR SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Kevin Gonzales, his team, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with: your use of our services, your violation of these Terms, your violation of any rights of another party, or any content you submit or share through our services.
14. TERMINATION
We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Grounds for termination may include but are not limited to: violation of these Terms, abusive or disrespectful behavior, non-payment, sharing of confidential or proprietary materials, or any conduct we determine to be harmful to our business or other clients.
Upon termination, your right to use our services will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.
15. DISPUTE RESOLUTION
Any dispute, controversy, or claim arising out of or relating to these Terms or our services shall first be attempted to be resolved through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration or the courts, as applicable under the governing law.
16. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Australia for the resolution of any disputes.
17. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
18. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
19. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and Kevin Gonzales regarding your use of our services and supersede all prior agreements and understandings, whether written or oral.
20. WAIVER
The failure of Kevin Gonzales to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Kevin Gonzales.
21. ASSIGNMENT
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
22. FORCE MAJEURE
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, government actions, or internet or telecommunications failures.
